All prices are inclusive of current, statutory value added tax without possible shipping costs. For delivery abroad we will charge individual shipping costs, for which you can ask us before dispatch.

Shipping Costs and Time of Delivery

The shipping costs per consignment amount the stated price in the shop/ Ebay to the address of delivery within Germany. After the receipt of payment the product will be dispatched within 3 working days. When the delivery is urgent, please contact sinusArt by telephone for special arrangements.

Returns

In case you do not want to keep an item (this is not valid for items purchased from an auction), you can return the product within 14 days (in perfect condition and original packing). Please inform us beforehand about your request to return the item, so that we can give you further instructions for the dispatch. SinusArt will take shipping costs of returns up to a goods value of 40 euros. Shipping costs of returns of higher goods value will take the customer.

Excluded form return are used, changed and/ or specially made goods. Sale goods cannot be exchanged or returned, unless the item has a defect. Further excluded from return is delivery, that we additionally have given confirmation, to which the customer did not contradict in writing within 48 hours. Whatever happens, please use the original packing for your returns and add a copy of the original invoice. With an order of a net goods value from 100 euros upwards, traders will automatically receive a written confirmation. The right of return and the avoidance of a sale lapse, if the confirmation is not contradicted within 48 hours.

Warranty

We reserve us the right to first repair defects free of charge during the time of warranty of 24 months after delivery. If necessary, we exchange the product. At first the right of change and a deduction from the price are ruled out. Will the defect not be repaired in an appropriate time, however, you have the possibility to choose between the right to withdrawal from the sales contract or the deduction from the price. Principally, a claim for warranty does not exist if the product is changed or damaged or if the defect is traced back to improper usage.

Reservation of Proprietary Rights

Up until the complete payment, the product remains property of sinusArt. Please, send neither cash nor cheques/ checks. In the case of loss we do not assume liability.

Mode of Payment

As means of payment we offer:
Bank transfer
Cash on delivery (unless dispatch of bulky goods)
Prepayment
Pay pal (credit card)

New customers can pay their first 3 deliveries only by cash on delivery or by advance payment. When orders are of a value from 100 euros upwards we insist on cash on delivery or advance payment. For familiar customers we reserve the possibility of an outstanding invoice with a credit period of 14 days net.

Default

In case you pay later than agreed upon or in case the payment cannot be carried out in time because of reasons that you have to justify, we reserve us the right to charge you overdue fines and default interest. For debit entries from your bank giro account we will additionally charge you 12,50 euro, irrespective from overdue fines and default interest. The evidence that no or only little damage is caused by the delay is free.

Withdrawal from Sales Contract

We reserve us the right to withdrawal from the sales contract when we get information which is a portent of the lack of financial solvency or willingness to pay.

Further we reserve us the right to withdrawal from the sales contract when it becomes conceivable that we cannot fully complete an order in time. We will immediately inform you about the withdrawal. The right to withdrawal from the sales contract is necessary because some of the items we offer have only a limited availability.

Electronic Evidence

We point out that we reserve the right to use electronic evidence in case of legal proceedings.

Data Protection

The customer agrees that, within the scope of business connection, his collected personal data and data that concerns our company will be saved and used in the electronic data processing of the sinusArt company. Hereby, sinusArt pledges itself not to pass down these data to a third party.

Court of Jurisdiction

Court of jurisdiction is Germany, unless otherwise expressly agreed or unless another regulation applies by act of law. The only applicable law is exclusively the one of the Federal Republic of Germany.

Severability Clause

In case that individual terms of these standard terms and conditions are not effective or that there exists a gap that has to be regulated, the standard terms and conditions shall endure for the rest. A formulation that is closest to the volitional one substitutes for the ineffective condition or the gap that has to be regulated. In case of discrepancies the German version of the standard terms and conditions does always apply.
